Who is Fiance:
A fiancé(e) is a person who wishes to enter the UK with a view to marriage to a sponsor who is either:
- already present and settled in the UK; or
- will be admitted for settlement in the UK when arriving there, and,
- intends permanent settlement in the UK.
Appeal Against Fiance Visa (UK FIANCE VISA REFUSED):
Following legislations allows First Tier Immigration and Asylum Tribunal to coduct an appeal hearing:
Nationality, Immigration & Asylum Act 2002
Asylum & Immigration (Treatment of Claimants etc.) Act 2004
Asylum & Immigration Tribunal (Procedure) Rules 2005
Two Ways to Appeal the Home Office/UKVI or Entry Clearance Officer Decision:
a) Oral Appeal, &
b) Paper Appeal
The Court fee to lodge a paper appeal is £80.00 whilst for the Oral Appeal it is £140.00.
What is a Paper Appeal
The paper appeal is an appeal that will be determined only on documentary evidence and the First-Tier Tribunal Immigration and Asylum Chamber will not call any witness to give evidence. To lodge a paper appeal, you must:
a) Attach grounds of appeal
b) Notice of Refusal
c) Duly filled in Appeal form/notice of appeal
d) Evidence you will be relying on
Once you lodge the paper appeal then the matter will be referred back to the Home Office/UKVI or Entry Clearance Manager to review it, if the Home Office/UKVI or Entry Clearance Officer decision will not be overturned then the appeal will proceed and then you must:
a) File a paginated inde to bundle of documents
i) Bundle should include a thorough witness statement of the applicant, sponsor or any other witness.
ii) All other appropriate and relevant documentary evidence to the appeal.
What is a Oral Appeal
It will be heard in the First Tier Immigration and Asylum Chmabers.
In overseas appeal the sponsor will need to attend the Immigration Tribunal to give Evidence, witness will be examined, cross examined and reexamined.
Paper Appeal fee is £80.00
Oral Appeal fee is £140.00
